				Plaintiff&amp;rsquo;s Summary of the Case: In June 2008, the plaintiff was working for a tree removal service when his boss asked him to help grind out a stump using a stump cutting machine. The plaintiff&amp;rsquo;s boss was unable to manipulate the throttle from behind the safety shield because the throttle cable on the stump cutter broke. He asked the plaintiff to operate the throttle by manipulating the intake lever on the engine by hand. The intake lever was located directly above a 70-pound cast iron flywheel that rotates to cool the stump cutter&amp;rsquo;s engine. While the plaintiff was operating the throttle intake lever, the flywheel exploded and took off his dominant pinky and ring fingers. The fingers were later surgically attached.

				&lt;span style=&quot;font-weight: bold&quot;&gt;Plaintiff&amp;rsquo;s Summary of the Case:&lt;/span&gt; The plaintiff, a native of India who came to the United States in 1985, operated a real estate partnership purchasing, leasing and selling gas station and convenience stores in Minnesota. On June 11, 2008, it was raining lightly and the plaintiff was proceeding eastbound on I-94 when the defendant truck driver lost control of his vehicle, crossed the westbound lanes of 94, proceeded through the ditch in a jackknifed position, and then slid across the eastbound lanes where his truck came to a rest perpendicular to the lanes of travel. The plaintiff, unable to avoid the crash, collided with the rear dual driving wheels of the tractor at a substantial speed.The defendant trucking company admitted that its driver was negligent but asserted negligence on the part of the plaintiff as well. The passenger in the plaintiff&amp;rsquo;s car informed the investigating trooper at the scene that the plaintiff was on his cell phone at the time he observed the truck coming into their lane.
