Waiver of Provision

Where the buyer executed a contract for deed for 13 apartment buildings; the contract contained a contingency clause requiring the seller to provide certain documents within 10 days and allowing the buyer to cancel the agreement within an additional ten days if the documents were not satisfactory; the buyer took possession and began managing the apartment buildings; and the buyer did not request any documents until nine months later; we conclude that the buyer waived the right to receive any outstanding contingency items and thus had no right under the contingencies provision to cancel the contract for deed. Affirmed.
