Expert Not Qualified
Where the contracting license of plaintiffs’ expert witness was revoked in 2001 following numerous complaints filed about him with the Department of Commerce; and the expert had recently been disqualified as an expert witness by a District Court judge in a separate case; we conclude that the District Court did not abuse its discretion by excluding the witness on the grounds that he was unqualified.
Further, because plaintiffs failed to disclose their intent to call any of their other witnesses as a causation expert until the day of trial, we conclude that the District Court’s dismissal of plaintiffs’ entire case was within its discretion. Affirmed.
